Notes to the Applicant

  1. The requirements stated in this application form are subject to change, to adapt to the continual development and evolvement of the gas industry. Until a licence is issued, you are advised to check with the Authority from time to time regarding the latest licensing requirements.
  2. If an application for the licence is granted, you will need to pay an initial licence fee (if applicable), and pay a subsequent annual fee.

Completion Instructions

  1. The estimated time to complete this form is 50 minutes.
  2. You will need the details of your company shareholders/directors and the proposed business to fill up this application form.
  3. Print clearly or type all information. If there is insufficient space in the form, please provide additional information in an attachment.
  4. For the purpose of this application,
    "Commercial Generation" means generation of electricity to be exported into the grid as set out in the Policy on Gas Import Control;
    "Firm Contracted Quantity" means in respect of a year, the maximum quantity of gas, expressed in either volumetric, mass or energy units, which, pursuant to the gas sale agreement / gas contract between the Applicant and its supplier, the supplier has a firm obligation to deliver to the Applicant during that year;
    "Maximum Annual Quantity" means in respect of a year, the sum of Applicant's firm contracted quantities or such other quantities approved by the Authority;
    "Non-Commercial Generation and other uses" means any form of electricity generation which is not commercial generation; and
    "Policy on Gas Import Control" means the Information Paper entitled "Policy on Gas Import Control" released by the Authority on 26 December 2006.
  5. Please submit the following list of documents together with the application:
    (a) Certified true copy of the Applicant's Certificate of Incorporation;
    (b) Certified true copy of the Applicant's Memorandum and Articles of Association;
    (c) Certified true copy of relevant ownership documents, including documents lodged with the Accounting & Corporate Regulatory Authority, ACRA (or equivalent authority in relevant jurisdiction) showing the shareholder structure, names and addresses of significant shareholders and the composition of the board of directors;
    (d) Certified true copy of the Applicant's gas sale agreements /gas contracts with its gas suppliers or such other document as available to validate the information required for the purpose of Part II (11); and
    (e) Audited past profit and loss statements, balance sheets and cash flow statements of the Applicant or the significant shareholders for the last 5 full financial years or since incorporation if less than 5 years and Credit statement or credit rating, including any history of bankruptcy or financial distress.
  6. All attachments shall be submitted in hard copies (TWO, 2 copies) to be sent to the address given above, to the attention of "Deputy Director, Economic Regulation & Licensing Branch, Regulation Division."
  7. If any information provided by the Applicant is of a confidential or commercially sensitive nature, please identify such information in a separate document by noting the relevant sections and citing reasons why the information is considered confidential or commercially sensitive.
