Note on Revised Section Numbers in the Electricity Act

This note is with reference to certain section numbers in the Electricity Act (indicated in the table below) which have been revised with effect 31 Dec 2021 by the Law Revision Commission in exercise of its powers under section 4(1) of the Revised Edition of Laws Act 1983.

Amongst other things, the former section 6(1)(ba) and (c) of the Electricity Act have been renumbered as section 6(1)(c) and (d) respectively, and the former section 6(1)(d) to (h) have been renumbered as section 6(1)(e) to (i) respectively. The table below shows a comparison of the changes. Similar amendments have been made to section 9(1) of the Electricity Act.

6.—(1) No person shall —
(a) engage in the generation of electricity;
(b) engage in the transmission of electricity;
(ba) transmit electricity for or on behalf of a transmission licensee (other than as an employee of the transmission licensee);

(c) engage in the retail of electricity;
(d) import or export electricity;
(e) provide any market support services;
(f) trade in any wholesale electricity market; or
(g) operate any wholesale electricity market, unless he is authorised to do so by an electricity licence granted under section 9 or is exempted under section 8.
(2) Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $500,000 and, in the case of a continuing offence, to a further fine not exceeding $12,500 for every day or part thereof during which the offence continues after conviction.

6.—(1) No person may —
(a) engage in the generation of electricity;
(b) engage in the transmission of electricity;
(c) transmit electricity for or on behalf of a transmission licensee (other than as an employee of the transmission licensee);
(d) engage in the retail of electricity;
(e) import or export electricity;
(f) provide any market support services;
(g) trade in any wholesale electricity market;
(h) operate any wholesale electricity market; or
(i) carry on any other activity relating to electricity that the Minister may, by order in the Gazette, specify, unless the person is authorised to do so by an electricity licence granted under section 9 or is exempted under section 8.

(1A) The requirement of an electricity licence in subsection (1) for a person that engages in the generation or transmission of electricity, imports or exports electricity, or trades in any wholesale electricity market, does not apply to the Authority.

(2) Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $500,000 and, in the case of a continuing offence, to a further fine not exceeding $12,500 for every day or part of a day during which the offence continues after conviction.

Notwithstanding the above, all references to the above former section numbers in licence conditions, codes of practice etc. which were in effect before 31 Dec 2021 will continue to be valid and effective as if they refer to the above amended section numbers/provisions, in view of section 20(1) of the Revised Edition of Laws Act 1983. For instance, references to section 6(1)(e) in the licence conditions relating to “Composition of the Board of Directors” and “Prohibition of Acquisition of Shares” in Licences in effect before 31 Dec 2021 shall be read to refer to section 6(1)(f) of the current Electricity Act.
