Amendments To Gas Act (Cap 116A)

Feedback was received from 14 respondents, viz. Mr Yip Pak Ling (Energy Market Company Pte Ltd), Tuas Power Ltd, Island Power Company Pte Ltd, ExxonMobil, Premier Oil Indonesia, City Gas Pte Ltd, PowerGas Ltd, Keppel Energy PteLtd, PowerSeraya Ltd, Temasek Holdings Pte Ltd, Gas Supply Pte Ltd, Senoko Power Ltd, Baker Botts LLP, and SembCorp Gas Pte Ltd.

Common concerns raised were on provisions governing the licensing regime for the agent/contractor to the gas transporter; provisions pertaining to control over the ownership and appointment of key personnel with respect to the gas transporter and its agent/contractor; measures to open access of the gas pipelines especially on prohibition of terms or conditions in contracts that are inconsistent to the Gas Network Code and EMA imposing allocation agreements to relevant parties.

A summary of the key concerns, and EMA’s responses are tabulated in the Appendix of the assessment paper. Feedback from eight of the respondents are also published for general information. Six respondents have requested for their feedback to be kept confidential.

Consultations

The Government announced in Mar 2000 its policy decisions to restructure the gas industry to facilitate competition in gas import and retail, with transportation to be undertaken by a single entity – PowerGasLtd. The Gas Act (Cap. 116A) (the “Act”) was passed in Mar 2001 to establish the regulatory framework for this. It is proposed that the Act be amended to implement the Government’s policies. This will allow new gas importers and retailers to have open competitive access to the gas pipeline infrastructure. It will also provide potential investors with greater clarity of the regulatory regimein the gas industry. EMA invites feedback from the public on the proposed amendments to the Act which is currently being reviewed by the Attorney-General’s Chambers. Please refer to the consultation paper for details of the proposed regulatory framework.
